Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the website certavent.com, its blog, and any associated progressive web app (PWA) install (together, the "Site"), operated by CertaVent ("CertaVent", "we", "us", "our"), presently run by Sebastian Dettlaff trading as CertaVent ("the Operator"), of Argyle Road 34A, West Sussex, Bognor Regis, PO21 1EB, United Kingdom. You can contact us at research@certavent.com.

By accessing or using the Site — including browsing our pages, reading the blog, or submitting the early-access/waitlist form — you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Who we are and where CertaVent is heading

CertaVent is a platform being built for the air duct cleaning industry, starting in the UK, to help duct cleaning companies generate compliance reports and TR19 certificates, with a longer-term plan to add a marketplace connecting businesses such as restaurants, pubs, care homes and schools with duct cleaning providers, and later expansion into the EU. The Site you're currently using is an early, pre-launch stage of that project: it exists to describe what CertaVent is building, publish blog content, and let interested people register for early access. Features, timelines, and functionality described on the Site are indicative of our current plans and may change, be delayed, or be withdrawn without notice as the product develops.

3. Scope of these Terms — and what comes next

These Terms apply to your use of the Site as it exists today: informational pages, the blog, and the early-access/waitlist form. They do not yet cover use of the CertaVent software platform itself (account registration, report and certificate generation, billing, or the future marketplace), because that service has not launched. Once business accounts go live, a separate SaaS Terms of Service (and, for business customers, a Data Processing Agreement covering our role in handling their data) will apply to use of the platform, and we will make that clear at the point you sign up. Continuing to browse the Site does not create any service relationship beyond what's described here.

4. Eligibility

The Site is intended for a business and professional audience — principally duct cleaning companies, tradespeople, and others interested in TR19 compliance — and for general members of the public researching the industry. You must be at least 18 years old to submit the early-access/waitlist form or otherwise provide us with your details.

5. Acceptable use

When using the Site, you agree not to:

  1. use the Site in any way that breaches applicable law or regulation;
  2. attempt to gain unauthorised access to the Site, our systems, or any account, or to probe, scan or test the vulnerability of our infrastructure without our prior written permission;
  3. use any automated system (bots, scrapers, crawlers other than standard search-engine indexing) to extract content from the Site without our consent;
  4. introduce viruses, malware, or other harmful code;
  5. reverse engineer, decompile, or attempt to derive the source code of any part of the Site or PWA, except to the extent this restriction is not permitted by law;
  6. impersonate any person, or misrepresent your affiliation with CertaVent or any duct cleaning business; or
  7. use the Site to transmit unsolicited advertising or promotional material.

We may suspend or restrict access to the Site for anyone we reasonably believe has breached this section.

6. Intellectual property

The Site, including its text, graphics, logos, the CertaVent name and coin mark, blog articles, and underlying software, is owned by us or our licensors and is protected by copyright, trade mark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to view and use the Site for your own personal or internal business informational purposes. You may not reproduce, republish, or commercially exploit any content from the Site without our prior written consent, except that you may share links to our blog articles or quote short excerpts with clear attribution, consistent with normal fair use.

7. Information you submit to us

If you submit information through our early-access/waitlist form, a contact form, or similar (for example, your name, email address, or company details), you confirm that the information is accurate and that you have the right to provide it. Submitting this information does not create any contractual obligation on us to provide you with access to CertaVent, a launch date, or any particular feature — we'll be in touch using the details you provide as the product develops. How we handle any personal data you submit is described in our Privacy Policy and our Cookie Policy.

8. Blog and TR19-related content

Our blog and other informational content about air duct cleaning, TR19, and related compliance topics is provided for general information only. It is not intended as, and should not be relied on as, formal compliance, engineering, fire-safety, or legal advice, and it does not replace a proper site-specific assessment by a qualified professional or the guidance issued by BESA/HVCA or the relevant regulator. We try to keep this content accurate and up to date, but standards and guidance change, and we don't guarantee that every article reflects the very latest version of any code of practice.

9. Third-party links

The Site may link to third-party websites (for example, industry bodies, accreditation schemes, or partner sites). We don't control those sites and aren't responsible for their content, availability, or privacy practices. Links are provided for convenience and don't imply endorsement.

10. No warranty

The Site is provided on an "as is" and "as available" basis. Because CertaVent is under active development, we don't guarantee that the Site will be uninterrupted, error-free, or available at all times, and we may change, suspend, or discontinue any part of it — including taking it offline entirely as we prepare for the platform's launch — without notice. To the maximum extent permitted by law, we exclude all warranties, express or implied, as to the accuracy, completeness, or fitness for a particular purpose of the Site's content.

11. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Subject to that, to the maximum extent permitted by law, we exclude all liability for indirect or consequential loss arising from your use of the Site, and our total liability to you arising out of or in connection with your use of the Site (as opposed to the future CertaVent platform, which will have its own terms) is limited to £100. This reflects the fact that the Site currently provides informational content and an early-access form, rather than a paid service.

12. Indemnity

You agree to indemnify us against any claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

13. Privacy and cookies

Our use of cookies and similar technologies is described in our Cookie Policy. How we handle personal data more generally is described in our Privacy Policy. Both should be read together with these Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales, and the English courts will have exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer-protection rights you may have under the law of the EU member state or other country in which you are based (for example, once our future marketplace serves EU-based restaurants, pubs, care homes or schools as consumers or small businesses, those mandatory local protections will continue to apply alongside these Terms).

15. Complaints

If you're unhappy with anything relating to the Site, please contact us first at research@certavent.com so we can try to resolve it directly. UK-based individuals also have the right to raise data protection concerns with the Information Commissioner's Office; EU-based individuals may contact their local data protection authority.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. We may assign these Terms in connection with a restructuring, sale, or transfer of the CertaVent business; you may not assign your rights under these Terms without our consent. These Terms, together with our Cookie Policy and Privacy Policy, form the entire agreement between you and us regarding your use of the Site.

17. Changes to these Terms

We may update these Terms as the Site and the CertaVent platform develop. We'll update the "Last updated" date above, and where changes are material, we'll provide a more prominent notice on the Site.
